Hi

I'm buying a one bed and a two bed penthouse in phase 2. Original completion date was 30th June 09. I now understand it to be sometime in March 2010. I am looking to pull out and get my money back. Does anybody know how easy this might be or has anyone been through it? Signature say they wont accept my termination (even though they are blatantly in breach) and say I will need to go through the turkish courts to get my money back as it's a turkish contract. What a palava. :35:

Absolutely no way you will get your deposit back,recession hitting everywhere.
Fight through the courts can prove costly and take years.And usually sides with the Turkish builder,I found the contract not to be worth the paper its written on.
Best of luck with whatever you decide.

Depends on your contract! Either way it will be a fight and an uphill struggle.

I am sure someone with more experience with this will advise.

I'm afraid Thingthong is right, you may get some recompense on the fact that it's delayed and you've not been able to have use etc;etc, but that all depends on what is in your contract. Hope all goes well, whatever you decide, I know it's frustrating to have to wait, but if you still want what you set out for there is no other option.

Get together with others who feel the same, dont piss about with turkish lawyers, get an international uk lawyer and hit them hard and quick.

Just my opinion but go for the cheap option and it will cost you plenty more.
You need a lawyer that knows his stuff particularly an understanding of turkish law.

One other point if others will go with you communicate off this site as you can be sure the builder is watching the comments, and will outsmart you.

Maybe an option, check it out.

Wise words from Juco in my honest opinion. Communicate privately with others in the same predicament. No disrespect to the normal users of TLF, also, London Legal getting some good press recently.

oh dear...not v positive ! My contract says i can get my money back, plus 6% of purchase price as compensation plus interest !! So, has anyone heard of acacia international? They are lawyers specialising in turkish law.....the 2 lawyer opinions say i stand a good chance....

Juco is right, the longer you wait and listen to any twaddle the longer they have to do 'whatever'. Get onto it straight away, find others who feel the same and join forces to instruct a solicitor, as Sharon says, London Legal are getting some good things said about them. Others on the site may not agree with you and see you as a trouble maker, be prepared for that because no matter how much they read they still wont take it in. Are you in Turkey?

Its just no good giving people negative advice, like they have no chance, the sooner people wise up the better. If things are going wrong in the early stages who knows whats really happening? The more people who take them to court the better the chance of changing things. Look at some of the messes on here because people wait till the bitter end and theres no money left for them after the creditors move in.

One piece of advise I would give you is, don't file in a piddlin little place (small town, village) find someone to file in the big cities where they understand their own laws and don't flout them!!!

Good luck and move NOW!

Carol is right, Juco is right, waiting a NO NO, strike while the iron is hot!!! As one of the wait brigade, keeping my head down hoping for a miracle, I now know that is wrong! It simply gives them leverage to deceive further.

I by no means wish to insinuate anything is wrong in your case BUT what I will say is, Go with your GUT instinct, listen to your inner voice, if you feel something is wrong it is ok to react and try and get the proper answers.

The biggest enemy of all is fear, I know I have been there. Many have been there, done that and are wearing the tee shirt, I am one of them, but NO longer. I have NO intentions of ending up with simply the tee shirt.

Good luck and have no fears to contact privately any of us with whom you feel you can relate. We may not be able to fix it for you, but I'm sure and certain you will get support and indicators of how to proceed.

Many of us are quite simply not going to bear this rot any longer, we will not change events which have passed but personally if I can save one person from heartache by being a support I will. Surely sometime soon things will have to change.

It is so so sad really I feel, so many good people are out there trying to make a living by doing the right thing, they unfortunately are not getting the breaks they deserve because of all the other guys simply ripping off. So unfair.

I dont think the contract was notarised and therefore may not be legal, but I understand that this is in our favour.

if its not legal, and i assume you mean not legally enforceable, then surely the seller has the aces if he has your money !

i dont think my contract is notarised, but i am told that if my contract is not legal then thats an argument for the lawyers to say that the sellers cannot force me to complete and cannot keep my deposit? all new to me.

And argue they will! and still be arguing in 10 years time while they keep your money.

If its not a legal document can they now say they never received any money for the property? As there is nothing to legally support that you did.

I hope I am wrong in that assumption.

Surely bank records would back this up. Also it's normal to include in the transfer records what the money is for ie. address of property being purchased.

I would have thought so but some have gone to court over this same situation and still lost their home never got their monies paid back.

Maybe down to which lawyer you use.
