Hi and help!
Does anyone know if I-not Turkısh-can divorce my non-Turkish husband from Turkey?
We got married over 10 years ago in Belfast and I haven't seen him/heard from him for nine years and I have no way of contacting him. I know that in the UK you can divorce someone if you prove that you have tried to contact them
Failing that, does anyone have any idea of how to find out if he's divorced me without me knowing?
Thanks in advance for any help/sugggestions

I'm pretty sure you would have to instruct divorce solicitors in the UK and take proceedings there. I would think it likely that you could do most of it by phone or on-line.

As the marriage was in Belfast I would presume you would need to divorce your husband through the NI courts.

You can do it yourself in the UK. Just look up DIY divorce on line, download the paperwork and instructions and see how it goes.

You cannot get divorced is the UK as, to do so, one of the partners has to have resided in the UK for a minimum of six months immediately prior to the commencement of the divorce proceedings. Howver, both Turkey and the UK are signatories to the Hague Convention on International Private Law which means that both countries recognise each others basic laws e.eg marriage, divorce etc. Therefore, a Uk marriage can be dissolved in Turkey; much more easily in fact. I know, I've done it. The problem is that not too many Turkish lawyers and judges are very knowledable about this and you may have to do some research yourself as I did and feed them the information.

Sorry Scooby I presumed you were still living in Belfast. Divorcing in Turkey, if that is where you're living, shouldn't be a problem.

Was your UK marriage registered with the Turkish authorities at the time?

Were you in contact with your wife at the time? I have no idea where my husband is and have no way of contacting him. He's not British, Turkish or from the EU and the last I heard was that he had moved to Eire; that was in 1992.
The reason I ask is that a friend-not British-is in a similar position and has been told by her Turkish lawyer that as they can't locate her husband, they can't proceed with the divorce and she has to go back to Canada to get divorced

Hi. Yes I was in contact with my wife. As you can't contact your husband, your only option for you to get divorced in the UK would be for you to live there for 6 months and then start a petition. However, I spoke to my lawyer who says that a divorce would be possible in Turkey provided that you can prove that you have been separated for the required length of time. He says a petition would be sent to his last known address and, if he didn't respond then procedings could commence.
